Dedicated Server T's and C's, and SLA
The following additional terms and conditions apply to the Dedicated Server service:

Ownership

Throughout the contract period the server hardware and any software pre-installed on the server will remain the property of Progressive Networks.

If you choose to install any additional software then you must own or have permission to use any such software on the server. Progressive Networks reserves the right to request copies of licenses for software used on the server.

Usage

The dedicated server must not be used to host or promote content or activities that are illegal in the UK. If the server is used for such purposes we will suspend access to and from the Internet for that server immediately, without notice and inform the relevant authorities.

Security

Throughout the contract period the customer is responsible for the security of the software and systems running on the server. If you pay for the server management option then we will ensure that the operating system and any software pre-installed on the server prior to the start of the contract have any relevant security patches applied to them.

If you believe that the security of the server has been compromised you must notify us immediately via our Technical Support department.

Hardware Maintenance and Failures

Although uncommon, in the event of an item of hardware failing on the server Progressive Networks reserves the right to shut down the server without notice to carry out repairs or to protect other items of hardware from subsequent damage.

If we wish to carry out maintenance on your server we will provide at least 3 working days of when we plan to carry out the works. If the stated date/time is inconvenient then please contact us via our Technical Support department and if possible we will attempt to reschedule to work for a mutually convenient time.

Please note: If we can't fulfil this service level agreement, any compensation will be limited to the total fees that you have prepaid, excluding setup fees.

Upgrades

At any time during the contract period, you can choose to upgrade you server, this can be in the form of a full server upgrade or on a component level to your existing server. Any upgrades are likely to result in an uplift of the rental fee, the increase will depend on the upgrades chosen. For more information and a quote, please contact our sales team.

99% internet uptime

Thanks to our multiple redundant connections to the internet, we are confident that your server will have excellent up-time.

In the unlikely event that our internet connectivity fails for more than one per cent of a calendar month, we will refund one day's service fee for every hour our internet connectivity is unavailable, not including the first one per cent of the month. We will refund no more than your monthly service fee.
